Po prenehanju delovnega razmerja pa je od delodajalca zahteval izpla\u010dilo denarnega nadomestila za njegov izrabljeni in nepla\u010dani ter tudi za neizrabljeni letni dopust, in sicer za celotno obdobje, v katerem je bil zaposlen.<\/p>\n<p>Delovno sodi\u0161\u010de je presodilo, da je ta posameznik &#8220;delavec&#8221; v smislu britanske zakonodaje, s katero je prenesena evropska direktiva o delovnem \u010dasu, in da je upravi\u010den do izpla\u010dila nadomestila za pla\u010dani letni dopust. Delodajalec se je prito\u017eil, prito\u017ebeno sodi\u0161\u010de pa se je z ve\u010d vpra\u0161anji obrnilo na Sodi\u0161\u010de EU.<\/p>\n<p>Kot so danes sporo\u010dili iz Sodi\u0161\u010da EU, je to v sodbi poudarilo, da ima vsak delavec pravico do pla\u010danega letnega dopusta in da je namen te pravice delavcu omogo\u010diti, da se spo\u010dije in da ima na voljo obdobje za sprostitev in razvedrilo. &#8220;Vendar delavec, ki je v \u010dasu svojega dopusta v okoli\u0161\u010dinah negotovosti glede denarnega nadomestila, tega dopusta ne more polno u\u017eivati. Take okoli\u0161\u010dine lahko delavca tudi odvra\u010dajo od tega, da vzame letni dopust,&#8221; je opozorilo sodi\u0161\u010de.<\/p>\n<p>Zato je tak\u0161no ravnanje delodajalca v nasprotju s ciljem pravice do pla\u010danega letnega dopusta. Poleg tega u\u010dinkovito pravno sredstvo ni zagotovljeno, \u010de mora delavec najprej vzeti nepla\u010dani dopust in \u0161ele nato vlo\u017eiti pravno sredstvo, da bi zanj prejel pla\u010dilo denarnega nadomestila.<\/p>\n<p>Sodi\u0161\u010de tudi ugotavlja, da pravo EU nasprotuje nacionalnim dolo\u010dbam ali praksi, v skladu s katerimi delavec neizrabljenih pravic do pla\u010danega letnega dopusta iz ve\u010d zaporednih referen\u010dnih obdobij ne more prenesti ali po potrebi kopi\u010diti vse do prenehanja delovnega razmerja, ker mu delodajalec za ta dopust ni hotel pla\u010dati nadomestila.<\/p>\n<p>Pri tem pa je opozorilo na primere, ko delavec pravice do pla\u010danega letnega dopusta pred prenehanjem delovnega razmerja ni mogel uresni\u010diti iz razlogov, neodvisnih od njegove volje (npr. zaradi bolezni). Sodi\u0161\u010de v tak\u0161nih primerih ne nasprotuje nacionalnim dolo\u010dbam ali praksi, da je kopi\u010denje pravic do pla\u010danega letnega dopusta omejeno na obdobje 15 mesecev, nato pa te pravice ugasnejo.<\/p>\n<p>A v obravnavanem primeru ni \u0161lo za polo\u017eaj, ko delavec ni mogel vzeti pla\u010danega letnega dopusta zaradi bolezni.
